Who Could Apply this January 2013 Canada Visa Application

Sunday, September 23, 2012

I know that many of you are still wondering who could really apply. So I am publishing  entry on my blog about the NOC O A B. Here are the professions that could apply this January 2013. As Minister Kenney twitted.

NOCs 0, A and B

But just like from what i had posted on New Canada Visa Application Concerns this is not considered as an official annoucment yet. But for the benefit to all of you on who could actually processed. Here is the List.

National Occupations Classification categorized in O- Managerial, A- Professional, B- Trade and Skilled occupations.
All Managers * All Engineers * All Information Technology related occupations * All Doctors * Accountants * All Supervisors * Nurses * Physical Therapists * Medical Technologists * Technical Sales Specialists * College Instructors * Social Workers * Administrative Officers * Purchasing Officers * Finance Managers * Chemists * Teachers * Boilogists * Architects * Dieticians * Librarians * Journalists * Writers * Electricians * Welders * Machinists and many more Occupations in the OA and B Categories of Canada...

If we compare this with the regulations that has been made operational since the FSWC processing became faster since last 2008, this will prove to be the easiest program that will be inacted.

So if you have plans of going to Canada, now is the time for you to apply.

This might be the last time that they will offer this program, historically when the program receives a lot of applicants a backlog happens and program is stopped to give way to a more strict and selective Canadian Immigration system.

The only way to be able to take advantage of this program is by completing your application package in advance and file right away after the FSWC program opens. If you don't you will miss out on this once in a lifetime opportunity because there will still be an overall quota for the total number of applications they will accept in a year.

At the very least you have to have your credentials assessed if you qualify

If in any case you are included on this list. You should be glad! Canada has open it up for you. Not anyone could have this wonderful opportunity of a lifetime.

Why Hire An Immigration Consultant

Just like I said If you think you can handle all the things for the immigration process by yourself, then, you are not a suitable candidate for choosing an immigration consultant.
Do you know there are quite a few fairly sound reasons to hire the services of an immigration consultant to ease the path for your immigration to any country? Hiring the services of any immigration consultant becomes all the more advisable if there is any legal complication posing a hurdle in the way of your immigration or you don’t have sufficient time or determination to complete the procedure for immigration.
A. Steps before Hiring an Immigration Consultant----
If you feel the need to hire an immigration attorney to handle your immigration case, then you need to keep in mind the following useful tips ------
1. Seek references—It’s always good to ask for recommendations from your family, friends or people whom you trust. Have a
dialogue with numerous immigration consultants before finally hiring one.
2. Ask about their qualifications and experience—Another point worth remembering is to know whether the immigration advisor is
authorized or not. If yes, find out his work experience as an immigration consultant.
3. Services and fee—You must know about the services to be provided and the fee to be charged by any immigration advisor and you must get all this information in writing to avoid any complication later on.
4. Ask queries—Don’t hesitate to ask queries and clear your doubts about the immigration lawyer.
B. Steps after Hiring an Immigration Consultant----
1. Get a contract in writing and read all the information on it before proceeding to sign the document. See various services mentioned and the fee to be charged for such services.
2. Don’t sign any blank application forms.
3. Ask for a receipt for any payments made by you.

and top top it up make sure that your consultants firm has a verified Canadian Lawyer Representative. If they dont have any you better think twice.

Canadian Immigration Consultancy has Atty John Weisdorf as their represantive. It's up to you who will you trust. As of this moment there are many Consultancy Firms that is starting to appear again maybe to take advantage of  the opening of Canada this coming January 2013. Remeber to ask for their credibility and success rate.

In CIC we stood to the test of time.

New Canada Visa Application Concerns.

Is it guaranteed that All NOCs 0, A and B will be eligible for the new Federal Skilled Worker Program?

After publishing the twitter account of Minister Kenney here at my blog. A lot of people are asking the guarantee of it. I had talk and mention this also to people who goes to our office for our assessment. And this is their concern also. Now to answer it one and for all.

The short answer is NO.  But let me explain...

There is no official announcement yet from Citizenship and Immigration Canada confirming the final details of New Federal Skilled Worker Program, the New FSW Points System and theIELTS Test Module Required. The information I'm sharing here is based on the statements of Canada's Immigration Minister, Jason Kenney.

You can read more about Jason Kenney from his official website:http://www.jasonkenney.com.  You will find in his website the Twitter Account (@kenneyjason) he is using.

Now, here's a couple of twitter messages from his account:

On the eligible occupations for the new Federal Skilled Worker Program.
NOCs 0, A and B

"The new Skilled Worker Program will be limited to applicants in NOCs 0, A, & B, but won't be limited to particular occupations." [August 18, 2012]

On the required IELTS Test Module.

IELTS General Training

"We will continue to use the IELTS General Training Module for language assessments under the new Skilled Worker Program." [September 6, 2012]

So there.  Now, it is up to you to decide how to make use of this information. This may still change, of course.  So you have two options: Prepare now or wait for the officialannouncement.

Remember, however, that there is a limit on the number of applications to be accepted.  If you will not prepare as early as now, there is a great chance that you will never make it. If you are really determined to live and work in Canada to give your family a better quality of life, you must do everything in your power to make it happen!

Canada Immigration Programs for Self Employed Class

Monday, September 10, 2012

Federal Self-Employed Class  is probably one of the most, if not the most, unpopular immigration of Canada.  Like the Federal Skilled Workers Program, it accepts only a limited number of application annually.  This program is targeted to those with experience in farm management and self-employment in cultural activities or athletics.

Self-employed person means a foreign national who has relevant experience and has the intention and ability to be self-employed in Canada and to make a significant contribution to specified economic activities in Canada.

Federal Self-Employed Class applications are being assessed using the 5 Selection Criteria Points System.  An application will be assessed based on Education, Experience, Age, Language Proficiency and Adaptability.

·         512 Writing, translating and related communications professionals

·         513 Creative and performing artists

·         525 Athletes, coaches, referees and related occupations

Qualified Proffesions in Canada Immigration Program

Unlike the previous Federal Skilled Worker programs in the past few years, the new FSWC program this coming January 2013 will no longer have limit on the number of applicants that will apply per occupation.

Moreover, it will be open to all occupations in the National Occupations Classification categorized in O- Managerial, A- Professional, B- Trade and Skilled occupations.

What does this mean? It means that All Managers * All Engineers * AllInformation Technology related occupations * All Doctors * Accountants * All Supervisors * Nurses * Physical Therapists * Medical Technologists * Technical Sales Specialists * College Instructors * Social Workers * Administrative Officers * Purchasing Officers * Finance Managers * Chemists * Teachers * Boilogists * Architects * Dieticians * Librarians * Journalists * Writers * Electricians * Welders * Machinists and many more Occupations in the OA and B Categories of Canada...

In Depth Look at Canada's New Pointing System

With the publication of the specific details of the proposed changes in Canada's FSW Points system in Canada Gazette*, applicants must make a move and start preparing to file their applications right now.

It looks like Citizenship and Immigration Canada is gearing up towards implementing the new regulations in the Federal Skilled Worker Class and start accepting applications as scheduled, which is on January 2013.

The lead time applicants have is best used to prepare for the requirements of the application for filling. Based on previous regulations, only those who are ready to file right away, are the ones who benefit from the fast and easy PR Visa application for Canada. "

Highlights of publication (New Points System in the Canada Gazette) In said publication Minister Jason Kenney (Citizenship and Immigration Canada) mentioned the following:

The Points system for the Federal Skilled Worker Class (FSWC) will be revised

Arranged Employment Opinion will be streamlined and strict procedures will be put in place to curb Fradulent Job Offers with these proposed changes in AEO, employers would be required to apply for a labour market opinion
(LMO) to HRSDC, whether it is in support of a temporary work permit application and/or a permanent residence
application

A New dedicated skilled trades class (FSTC) will be created. Which will be applicable to NOC B occupational areas: Industrial, Electrical and ConstructionTrades; Maintenance and Equipment Operation Trades; Supervisors and Technical Occupations in Natural Resources, Agriculture and Related Production; Processing, Manufacturing and Utilities Supervisors and Central Control Operators; as well as Chefs and Cooks, and Bakers and Butchers. To qualify an applicant must have a valid job offer of up to 2 employers in Canada or a certificate of qualification from a provincial Apprenticeship Authority, take language proficiency test and meet minimum required scores, at least 2 years work experience in the declared occupation within the last 5 years and meet all other requirements for the occupation based on the National Occupations Classification NOC of Canada except licensing requirements because its hard to get it if applicant resides outside of Canada.

Modify the requirements of the Canadian Experience Class - CEC to make it easy for those who are already in Canada and has proven that they can easily succeed in Canada by requiring less work experience for applicants. CEC is only applicable to applicants who are already in Canada who are working or worked in NOC Categories O - Managerial, A - Professional and B Trade Skilled occupations in Canada.

Of the three PR Programs in Canada the Federal Skilled Worker Class - FSWC is the one who receives the most applicants, the following is the proposed Changes in the points System.

Language Factor
1. It is proposed that there will be a minimum language scoresto qualify for the program. It is set at Canadian Language Benchmark 7 (CLB 7) for all four abilities (speaking, listening, reading and writing). It's equivalent to IELTS Score of 6. If applicant has points lower than 6 they would have to retake the IELTS Test again.

2. The number of points for the second official language (French) would be reduced from 8 points to 4 points. 3. Significantly increasing the maximum points awarded for fluency in one official language from 16 points to 24 points.

The computation would be as follows:

CLB 7 (IELTS score 6 in all areas) = 4 points

CLB 8  (IELTS score 6.5 for Reading, Writing and Speaking. Listening 7.5) = 5 points

CLB 9  (IELTS score of 7 for Reading, Writing and Speaking. Listening 8) = 6 points

Age Factor
The proposal is to favor younger applicants by awarding a maximum of 12 points for applicants aged 18 to 35 and a deduction of 1 point for every year after 35:

36 years old = 11 points
37 years old = 10 points
38 years old = 09 points
39 years old = 08 points
40 years old = 07 points
41 years old = 06 points
42 years old = 05 points
43 years old = 04 points
44 years old = 03 points
45 years old = 02 points
46 years old = 01 points
47 years old = 00 points

Work Experience Factor
Total points for work experience will be reduced from 21 to 15, work experience required to achieve full poitns will be increased from four years to six years.

1 year = 09 points
2-3 yeas = 11 points
4-5 yeas = 13 points
6 + yeas = 15 points

Adaptability Factor
Proposed changes in the adaptability criteria are as follows:

Maximum is 10 points.

10 points - PA Previous Work in Canada (min. 1 yr at NOC 0, A, B)
05 points - Previous study in Canada — PA
05 points - Previous study in Canada — accompanying spouse/partner
05 points - Previous work in Canada — accompanying spouse/partner
05 points - Arranged employment
05 points - Accompanying spouse/partner’s official language (CLB/NCLC 4) 05 points - Relative in Canada (18 years or over)

The proposed changes aims to emphasize factors that are shown to have positive impacts on an immigrant’s economic and social integration.

Spouse points of (3-5) no longer included in the adaptability points.

Education Factor
Education points would be awarded based on the equivalent Canadian educational credential and points would be awarded in recognition of the credential’s relevance in the Canadian standards.

Designated organizations would work on a case-by-case basis to authenticate credentials obtained in foreign jurisdictions and determine their equivalent value in Canada.

25 points - Doctoral level
23 points - Master’s level or professional degree
22 points - Two or more post-secondary credentials, one of which is a three-year or longer post-secondary credential

21 points - Three-year or longer post-secondary credential
19 points - Two-year post-secondary credential
15 points - One-year post-secondary credential
05 points - Secondary school

Without assessment from the organization designated by Citizenship and Immigration Canada, you can't claim points for the education factor.

Pass mark would still be 67 points.

IMPORTANT: If you have a valid IELTS Examination Score but with score of lower than 6 in any of the four areas, it will no longer be valid. You must take scheduleanother examination. No word yet if the new requirement would now be the Academic Module although the current requirement in Canada's Operational Manual for PR VISA Overseas processing still says its General Training.
